Privacy Policy

1. Introduction

Famaly ("Famaly", "we", "us", "our") is a family organiser for busy households — a shared calendar, chores and pocket money, family chat, meal planning, live family map and more, delivered through our website, family portal and mobile apps (together, the "Services"). Famaly is operated by OWNA Corp Pty Ltd (ACN 613 387 474).

We take privacy very seriously. This policy explains what Personal Information we collect, how we use it, who we share it with, and the choices you have. We are committed to handling Personal Information in accordance with the Privacy Act 1988 (Cth), the Australian Privacy Principles (APPs) and the Notifiable Data Breaches scheme.

Your family's data belongs to your family. You keep ownership of everything you upload (see our Terms of Use), we never sell your Personal Information, and you can ask us to delete it at any time (see section 12).

2. Application

This policy applies to all Personal Information we obtain through the Services, including information submitted through our website, the family portal and our mobile apps, and information collected automatically when you use the Services. "Personal Information" has the meaning given in the Privacy Act.

3. What we collect

Account and family information

  • Your name, email address, mobile number and date of birth;
  • Names, dates of birth, photos and profile details of family members you invite and children whose profiles you create;
  • Email addresses you enter when sending a family invite.

Content your family creates

  • Chat messages and chat attachments (photos, videos, documents and voice notes);
  • Calendar events, chores, shopping lists, meal plans and notes;
  • Child growth records and milestones, including photos, videos and documents you attach to them;
  • Dietary preferences and allergy information you record for your household.

Location information

Famaly collects precise and approximate location data from your mobile device. Where you have enabled location sharing and granted the relevant permission, the app collects this data while you are using it and in the background — including when the app is closed or not in use. Full details of what we collect, why, who it is shared with and how long we keep it are in section 6.

  • Your device's geographic location (latitude and longitude) and the accuracy of that reading;
  • Speed, heading and whether the device is currently moving or stationary;
  • Your device's battery level, so your family can tell a flat battery from a device that has stopped reporting;
  • Check-ins you perform, and the location recorded at the moment you check in;
  • Safety alerts raised by your device (for example a detected impact), including the location at the time of the alert.

Device and technical information

  • Push-notification device identifiers, device platform and device name;
  • Log and usage information such as IP address, browser type and pages accessed.

Payment information

If you subscribe to a paid plan, payments are handled by our payment processor or the app store you purchased through. We do not store your full card number on our systems.

4. How we collect it

We collect Personal Information when you register, when you or your family members enter it into the Services, when the mobile app sends it with your permission (for example location updates or push tokens), when you contact us, and automatically through your use of the Services. Information about children is provided to us by their parents or guardians, or by family members those parents or guardians have invited.

5. How we use it

  • To provide and personalise the Services and their features;
  • To show your live location and safety alerts to members of your own family group only (see section 6);
  • To generate AI-powered suggestions such as meal plans, lunchbox ideas and gift ideas (see section 7);
  • To send notifications you have enabled (push notifications, invite and service emails);
  • To respond to enquiries, provide support and handle feedback or complaints;
  • To process payments and manage subscriptions;
  • To verify identity, protect our legal interests, prevent fraud and misuse, and comply with our legal obligations;
  • For any other purpose with your prior consent.

We may use aggregated, de-identified data to understand how the Services are used and to improve them. When your Personal Information is included in de-identified, aggregated data, it is not possible to identify you from that data. You can opt out of marketing emails at any time using the unsubscribe link in each email.

6. Location data — how we access, collect, use and share it

Your location is only visible to your family. Location information is shared only with members of your own family group. It is never made public, never sold, never shared with advertisers or data brokers, and never used for advertising or any purpose unrelated to the features described below.

What we access and collect

With your permission, the Famaly mobile app accesses your device's location services and collects precise location (latitude and longitude, with an accuracy reading) and approximate location. Alongside each location reading we collect your speed, heading, whether the device is moving or stationary, and your device's battery level.

Background location collection. The features described below only work if your location can be reported while you are not actively looking at the app. Where you have enabled location sharing and granted background location permission, Famaly therefore collects location data in the background — including when the app is closed or not in use. The app sends readings periodically rather than continuously, and reports less often when your device is stationary in order to conserve battery.

Why we collect it

We collect location data solely to provide the family safety features you have chosen to use:

  • Live family map — so members of your family group can see where each sharing member currently is;
  • Check-ins — so you can tell your family you have arrived somewhere, with the location recorded at that moment;
  • Arrival alerts — so your family can be notified when a sharing member reaches a place that matters, such as home or school;
  • Safety and impact alerts — so that if your device detects a possible crash, your family is shown where it happened and can check on you.

We do not use location data for advertising, profiling, marketing, analytics about you as an individual, or to build a profile of your movements for any purpose other than the family-facing history views described below.

Who it is shared with

Location data is visible only to members of your own family group in Famaly. We do not sell it, and we do not disclose it to third parties for their own purposes. The only third parties who handle it are the cloud infrastructure providers who host the Services on our behalf (see section 9), and law enforcement or regulators where we are legally required to disclose it.

How long we keep it

  • Fine-grained location history is kept only for a short period (approximately 48 hours) before it is automatically deleted;
  • A reduced set of summary location points is kept for up to approximately 90 days to power history views, then automatically deleted;
  • Safety alerts are retained so your family has a record of them and can be resolved by any family member.

Your control over location sharing

  • Location sharing is off until you turn it on, and you can turn it off again at any time from within Famaly;
  • You can grant, restrict or revoke Famaly's location permissions — including background access — at any time in your device settings (Settings → Apps → Famaly → Permissions on Android; Settings → Famaly → Location on iOS). Revoking permission stops collection immediately; the safety features that depend on it will stop working;
  • The app makes it visible when sharing is active, so a person sharing their location always knows it is on;
  • You can ask us to delete location data we hold about you at any time — see section 12.

7. AI features

Some features (such as weekly meal plans, lunchbox ideas and gift ideas) are generated using an AI model provided by Anthropic. When you use these features, the relevant inputs — such as your fridge contents, household allergy list, or a child's first name and age — are sent to the AI provider to generate the suggestion. Under our provider's API terms, this data is not used to train their models. We recommend not entering information into AI features that you would not want processed this way. AI outputs are suggestions only — see our Terms of Use regarding checking ingredients and allergens.

8. Disclosure of Personal Information

We will not sell your Personal Information to anyone.

We disclose Personal Information only:

  • To your family group — content and location you share through the Services is visible to members of your family group (and, for chat channels you create or join, the members of that channel);
  • To service providers that help us run the Services, limited to what they need and subject to obligations to protect it, including cloud hosting and storage (Google Cloud, MongoDB Atlas), AI processing (Anthropic), transactional email (Mailgun), push notifications (OneSignal) and mapping (Google Maps);
  • Where required or authorised by law, to enforce our terms, or to protect the rights, property or safety of Famaly, our users or others;
  • In a business transfer — if our business is acquired, Personal Information may be transferred as an asset, subject to this policy;
  • With your consent, for any other purpose.

9. Overseas storage and disclosure

We use reputable international cloud providers to host and operate the Services. This means some Personal Information (including content you upload) may be stored or processed in countries other than Australia, including the United States. Where information is held overseas, it may be accessible to courts, law enforcement and national security authorities in that jurisdiction. We take reasonable steps to ensure overseas providers handle Personal Information consistently with the APPs.

10. Security

We use industry-standard measures to protect Personal Information, including encryption of traffic between your device and our servers, private cloud storage with short-lived signed access links for files, family-scoped access controls, and least-privilege access for our personnel. Our separate Security Policy describes these measures in more detail. No method of transmission or storage is 100% secure; please keep your password confidential and contact us immediately if you suspect unauthorised access to your account.

11. Children's information

  • Child profiles are created and controlled by a parent or guardian, who decides what is recorded and who is in the family group that can see it;
  • We collect information about children only as needed to provide the Services, and we require that the person providing it has the authority to do so;
  • Parents and guardians can review, edit or delete their children's information at any time from within the Services, or by contacting us;
  • We never use children's information for marketing and never disclose it to third parties except as needed to provide the Services or as required by law.

12. Access, correction and deletion

You have the right to request access to and correction of the Personal Information we hold about you. Most information can be viewed and edited directly in the Services. You may request deletion of your Personal Information ("right to be forgotten") at any time by written notice; we will use our best endeavours to delete it within a reasonable timeframe, unless we are required by law to retain it.

To make a request, email support@famaly.ai or write to The Privacy Officer, Famaly, Suite 213, 29-31 Lexington Drive, Bella Vista NSW 2153. We may need to verify your identity before acting on a request, and will advise you in advance if any cost applies.

If you are dissatisfied with our handling of a privacy complaint, you may contact the Office of the Australian Information Commissioner (oaic.gov.au).

13. Retention

We retain Personal Information only as long as necessary for the purposes set out in this policy, to comply with legal obligations, resolve disputes and enforce our agreements. Location history is automatically purged on the schedule described in section 6. If you cancel your account, content you posted into shared spaces may remain visible to the family members it was shared with, and residual copies may persist for a limited period in backups before being removed.

14. Cookies and statistical information

We collect statistical information such as pages accessed, visit times, browser type, operating system and IP address, and we use cookies and similar technologies necessary for the Services to function (for example, keeping you signed in). We do not track your activity across other websites or services. Our website may contain links to, or embedded content from, third-party sites whose privacy practices we are not responsible for.

15. Changes to this policy

We may update this policy from time to time by posting the updated version on our website. For material changes we will make reasonable efforts to notify you, for example by email or a notice in the Services. Your continued use of the Services after an update constitutes acceptance of the updated policy.
